Federal law requires that every employer who recruits, refers for a fee, or hires an individual for employment in the U.S. must complete Form I-9, Employment Eligibility Verification. The U.S Citizenship and Immigration Services oversees the I-9 process. While the I-9 is the most used government form, the information does not go necessarily go into a central data bank. Some employers use E-Verify, third party companies, or complete the I-9s internally.

In 2025, U.S. Immigration and Customs Enforcement (ICE) significantly ramped up I-9 administrative reviews and audits, with a renewed focus on strict workplace enforcement and substantially higher penalties.
